Part A

Using Swastya: Aira, Harvey and Teresa

These terms apply when you use Swastya on WhatsApp, whether you came to us directly or through your clinic or hospital. They apply alongside our privacy policy.

A1

What Swastya is

Swastya is AI care on WhatsApp. Aira explains your lab report, Harvey plans meals around food you already eat, and Teresa coaches you one small habit at a time for 12 weeks, through to your retest.

Aira, Harvey and Teresa are AI, not people. If you joined through your clinic or hospital, their messages come in your clinic’s or hospital’s name.

A2

Not medical advice

Swastya gives health education and coaching. It doesn’t diagnose, treat or prescribe, and it doesn’t replace your doctor. AI can make mistakes, so check anything important with your doctor before you act on it.

If your report or something you tell us looks urgent, a person steps in. In an emergency, call 112 in India or 911 in the US. Don’t wait for a reply on WhatsApp.

A3

Who can use it

You need to be 18 or older to use Swastya. If you share a report for someone else, such as a parent or a child, you confirm that you have their permission or are their guardian.

A4

Your conversation data

Your conversations with Aira, Harvey and Teresa, the reports you share and what you tell us in them (“conversation data”) are owned by Swastya AI.

  • We use conversation data to run your care: to explain your report, plan your meals and coach you.
  • Unless you opt out, we also use it to improve Swastya: to check the quality of our replies and to train and test our AI models. Before we do, we remove your name, number and other details that identify you wherever we can.
  • We never sell conversation data, and we never use it for advertising.

Owning these records doesn’t take away your rights under data protection law. You can still ask to see, correct or delete your personal data, as our privacy policy explains.

A5

Opting out of data usage

You can opt out at any time with one WhatsApp message to Aira (+91 72910 56530): “Opt out of data usage”. Open WhatsApp with the message ready.

We confirm on WhatsApp. From then on, we stop using your conversation data to improve Swastya or train our models. We still use it to run your care, and we keep what the law requires us to keep.

Opting out doesn’t stop your coaching. To stop all messages, reply STOP. To delete your data, email apoorv@swastya.ai.

A6

The laws we follow

We handle health and personal data in line with the laws that apply to you.

  • India: the Digital Personal Data Protection Act, 2023; the Information Technology Act, 2000 and its rules on sensitive personal data; and the Telemedicine Practice Guidelines, 2020.
  • United States: HIPAA and the HITECH Act, where we work for a clinic or hospital under a business associate agreement; the FTC Act and the FTC Health Breach Notification Rule; and the state health-privacy laws that apply to you.
A7

Changes, governing law and contact

If we change these terms we update this page and move the date at the top. If a change affects you, we tell you on WhatsApp. These terms are governed by the laws of India, and the courts at Bangalore have jurisdiction. Nothing here takes away rights you have under the laws of the place where you live.

Part B

Swastya Ads for diagnostic laboratories

The terms on which Swastya AI provides Swastya Ads to diagnostic laboratories, including the disclosures Google requires of third parties managing Google Ads accounts.

B1

These terms, and who they are between

These terms govern the supply of Swastya Ads by Swastya AI (“we”, “us”) to a diagnostic laboratory (“the laboratory”, “you”). They apply alongside the written plan and fee we agree with you, and alongside our privacy policy.

They do not replace your own agreement with Google. Your use of Google Ads is governed by Google's terms, directly between you and Google.

B2

What the service is

Swastya Ads plans, builds and manages Google Search campaigns inside your own Google Ads account, and reports on them. Specifically, our capabilities are campaign creation, campaign management, and reporting.

We do not, and the service does not:

  • create Google Ads accounts;
  • manage account-level settings;
  • touch billing or take payment on Google’s behalf;
  • build or manage any campaign type other than Google Search — Search campaigns are all we do.
B3

Your account stays yours

You own your Google Ads account and your billing relationship with Google. You pay Google directly for your own media. You grant us access through Google's OAuth consent screen, and that access is limited to managing your campaigns and reading your reporting.

Disassociation and exclusive control

You may disassociate your Google Ads account from Swastya Ads at any time and regain exclusive control of it. You can revoke our access yourself, immediately, from your own Google Account. If you ask us to disassociate the account, we action it within 3 business days. Campaigns already built remain in your account and under your control.

B4

Approval before anything spends

We put every campaign plan and its monthly cost to you in writing before it runs. Nothing is enabled until you approve it. If we want to change your budget, we ask first.

B5

Our fee, and what Google charges

  • We charge a fixed monthly fee per laboratory. Our fee is never a percentage of your ad spend.
  • The exact amount Google charges for media is shown to you separately from our fee, in every report and on every invoice. We report Google cost exactly as Google charges it, with nothing of ours added to it.
  • You are told our fee in writing before your first purchase, and it appears as a separate line on your invoices.
B6

Reporting, and telling you when it is late

We report weekly on spend and on patients collected, by test category, and we show Google Ads cost, clicks and impressions at the account level.

If our reporting of Google Ads performance is delayed by more than 24 hours — whether because of an API outage, a data-processing delay at our end, or anything else — we tell you, and we say what the delay is.

B7

Features we do not offer

Swastya Ads does not expose every feature available in Google Ads. Where a Google Ads feature is not available in our tool, we disclose that to you rather than leave you to assume it is running. In particular, campaign types other than Google Search are not supported, and account-level and billing functions are not available through us.

You always retain the ability to use any Google Ads feature directly in your own account.

B8

Your data

We will not sell, redistribute or sub-license your Google Ads data without your written consent. We do not pool it with another laboratory's data.

No patient-identifying information is used for advertising or sent to Google. Conversions we upload carry only the Google click identifier, an invoice value, and a timestamp. Full detail is in our privacy policy.

B9

What we need from you

  • Give us accurate information about your laboratory, the tests you offer, your prices and your turnaround times, and tell us when they change.
  • Hold the registrations and approvals your laboratory needs to operate and to advertise its services.
  • Keep your Google Ads account funded, so approved campaigns can run.
  • Do not ask us to run advertising that breaches Google’s advertising policies or Indian law.

Ad copy is written to describe availability, price and turnaround. We do not make claims about diagnosis, cure, accuracy or health outcomes, and we will not run copy that does.

B10

No affiliation with Google

Swastya AI is an independent company. We are not affiliated with, endorsed by, or certified by Google, and we are not a Google Partner. Google Ads and Google are trademarks of Google LLC.

Google publishes its own guidance for advertisers working with third parties, and we share it with every laboratory before they sign: Advertiser guide: Working with third parties.

B11

What we can and cannot promise

We will run your campaigns with reasonable skill and care. We cannot promise a particular position, a particular cost per click, a particular number of patients, or that Google will approve any given ad — those depend on Google's auction and policies, which we do not control.

We are not liable for indirect or consequential loss. Our total liability in any twelve-month period is limited to the fees you paid us in that period. Nothing here limits liability that cannot be limited by law.

B12

Ending the agreement

Either of us may end the agreement with 30 days' written notice. Fees are payable up to the end of the notice period. On termination we disassociate your account within 3 business days, hand over what we hold for you, and delete your credentials as described in the privacy policy. Your campaigns and your account remain yours.

B13

Changes, governing law and contact

If we change these terms we will update this page, move the date at the top, and tell current laboratories directly. These terms are governed by the laws of India, and the courts at Bangalore have jurisdiction.
